TERMS & CONDITIONS

The General Terms and Conditions for Berlin Zouk Festival in legal relationships between participants and the BZF Team. By registering and attending the festival, Participants acknowledge that they have read, understood, and agreed to these Conditions. These also apply to all artists, unless other rules have been agreed upon separately.

 

1. Event Organizer: These General Terms & Conditions (hereinafter referred to as "Terms") apply to all participants, attendees, artists, and BZF team (hereinafter collectively referred to as "Participants") of the Event (hereinafter referred to as the “Berlin Zouk Festival") organized in Berlin, Germany.

 

2. Registration and Attendance: BZF publishes the ticket prices for events online on their website and ticket platform Ticket Tailor and Go&Dance. Changes to the ticket price are on a demand basis and are announced in advance on official social media. By purchasing tickets, a contract governing attendance at the event is established exclusively between the purchaser and the presenter. By registering and attending the Event, Participants agree to comply with these Terms and any additional rules or regulations specified by the BZF Organizer.

 

2.1 Damage of Arm Band: In cases of Damaged armbands, please bring the damage one to the check-in counter and get the new one. If Damage one is not available then it is not possible to provide a new one and the organizer has no liability and entry to the event will be denied.

 

3. Event Schedule: The Event Organizer will provide a schedule outlining the date, time, and location of various activities, workshops and social dances during the Event on the official website. All content is subject to change without notice. The Participants are responsible for checking the schedule and adhering to the designated timings. here is no legal claim for late arrival to the event. If the visitor is late to the event, the visitor has no claim for a refund of the ticket price.

 

4. Code of Conduct: Participants are expected to behave in a respectful and appropriate manner throughout the Event. Any form of harassment, discrimination, or disruptive behaviour will not be tolerated. The Event Organizer reserves the right to take appropriate action, including expulsion from the Event, against individuals found violating this code.

 

5. Liability: The Event Organizer will take reasonable measures to ensure the safety and security of Participants and their belongings. However, the Event Organizer will not be held liable for any injury, loss, damage, or theft that may occur during the Event. Participants are advised to take necessary precautions and secure their personal belongings.

 

6. Photography and Videography: Participants may be photographed or recorded during the Event. By attending the Event, Participants grant the Event Organizer the right to use their image, likeness, and recordings for promotional purposes, including but not limited to marketing materials, social media, and website content. Video and/or audio recordings and photography by any electronic means are strictly prohibited during all workshops and parties, unless explicitly allowed by the participating artists or the organizer. This also applies to recordings made only for private use. Xplosion reserves the right to make or permit third parties to make audio and/or video recordings or broadcasts of individual events. BZF is entitled to use such footage, specifically including the right to copy, disseminate, show it publicly or make it accessible to the public.

 

7. Ticketing and Refunds: Participants must purchase tickets for the Event as per the designated pricing and payment methods. All ticket sales are final, and no refunds will be provided unless the Event is cancelled by the Organizer. In case of cancellation, the Event Organizer will provide information on refund procedures, if applicable.

 

7.1 Cancellation/Postponed of Event: If an event is postponed, tickets already purchased keep their validity for the new date in most cases. If the event is cancelled, tickets lose their validity and can be returned. the Event Organizer will provide information on refund procedures, if applicable.

 

7.2 Changes of Schedule: BZF reserves the right to change the programme and/or cast for organisational or artistic reasons; such changes do not justify a claim to return or exchange passes. In case an event is cancelled, tickets may be exchanged for our next event, First come first serve. Refunds will not be made for events which are stopped or cancelled after half of the regular event duration or after the interval has passed. In case an event is cancelled before half of the event time has elapsed, the rules and regulations stated above shall apply accordingly.

 

7.3 Transfer of Passes: To transfer a pass for the ticket purchased through Ticket Tailor must be done through an email to Berlinzoukfestival@gmail.com and the process will be communicated, the latest 14 days before the event date.

 

7.4 Changes and Cancellations: The Event Organizer reserves the right to modify the Event schedule, workshop lineup, or venue due to unforeseen circumstances. Participants will be notified of any changes as soon as reasonably possible. In the event of cancellation, the Event Organizer will refund the ticket price, but will not be responsible for any other expenses incurred by Participants.

 

8. Personal Responsibility: Participants are responsible for their own health and well-being during the Event. It is recommended that Participants consult their healthcare provider before participating in physically demanding activities. The Event Organizer will not be held liable for any injuries or health-related issues arising from participation in the Event.

 

9. Clockroom: Participants in a dancing event may choose to utilize a clockroom service to store their belongings. While organizers have a duty of care to safeguard items, participants should be aware of potential limitations of liability. By using the clockroom, participants assume a degree of responsibility for their belongings and accept any associated risks. Organizers may have disclaimers stating they are not liable for loss, theft, or damage unless caused by gross negligence. It's advisable for participants to exercise caution and take necessary precautions with their valuables. Consulting the event's terms and conditions can provide further clarity on clockroom liability. All items can be checked in the for free of charge; however, Xplosion reserves the right to charge a cloakroom fee at special events. Xplosion holds no liability for items stored in the cloakrooms.

 

10. Storage and Use of Personal Data: Personal data of customers will be collected and stored to the extent necessary to initiate and execute the purchase contract, and in keeping with data protection laws. Within this framework, BZF also uses the data for customer service purposes and to inform customers about further offers. Data will only be shared with third parties inasmuch as necessary to fulfil contractual obligations. The customer has the right to protest the collection, processing and storage of personal data, and to demand the blocking of disputed data, the deletion of data which have been stored in violation of data protection laws or which are no longer necessary, and the correction of incorrect data.

 

11. Age Restriction: Entry is permitted to individuals of legal age of 18 Years or Older.

 

12. BZF Authority: The BZF Authority Managing Director & BZF team incharge for the premises of ZOUK FESTIVAL. This authority is also exercised by the evening supervisors, the front desk staff, ticket office and other persons who have been accordingly authorized by the Managing Director. All participants must follow the instructions of these persons. If we have any complaints or suspicious activity may be removed from ongoing events authorized by the above-mentioned team. In such cases, they will have no claim for the refund of their ticket price.

 

13. Valid ticket / Pass: The Participants can only attend the workshop / Parties indicated on their ticket for the event registered. If Participants attend any other workshop which is not part of the Registered ticket without permission, we will charge the ticket price for which you have attended without proper ticket or remove from the event immediately. In such cases, they will have no claim for the refund of their ticket price.

 

14. Security Measures: For a BZF event, implementing a thorough security check is crucial to ensure the safety of attendees. The check should involve measures such as bag inspections & metal detectors. Trained security personnel should be present to identify and respond to any potential threats or prohibited items. Clear signage indicating the security procedures should be displayed, and attendees should be informed in advance about the security measures in place. Effective security checks can help create a secure environment and provide peace of mind for both organizers and attendees. participants who refuse to consent to the safeguarding of objects which may endanger the event or its visitors will be excluded from the event. Participants excluded for this reason have no claim for a refund of their ticket price. Depending on the nature of the event, it may be prohibited to bring bags and similar containers or bulky items into the event venue.

 

15. Lost and Found Items: Items of any kind found at BZF must be handed to the team members. Any lost items should be reported to the same persons. Further treatment of found items shall be governed by the regulations of §§ 978ff. of the German Civil Code (BGB).

 

16. Fire & Safety Measures: In cases of fire or other dangerous situations, participants must leave the venue immediately via the most direct route, using the exits and emergency exits marked. In such cases, checked items will not be returned before evacuation. Participants must follow the instructions of Security, staff or other persons authorised by BZF, without exceptions.

 

17. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Germany. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Germany. These General Terms and Conditions take effect from Jun 10th, 2022.

 

By registering and attending the BERLIN ZOUK FESTIVAL, Participants acknowledge that they have read, understood, and agreed to these General Terms & Conditions.
